What is a public liability claim?
Everyone is entitled to feel safe in public spaces and should not be exposed to unnecessary danger. Yet accidents sometimes take place because of another party’s negligent conduct. A claim in negligence may be made against a responsible party if a dangerous hazard should have been noticed and rectified.
Both private and public property owners that allow members of the public to use their property are expected to maintain a safe environment and prevent any hazards from causing harm. A hazard should be promptly removed, or potentially affected members of the public must be warned of its existence.
If you are injured as a result of an accident on someone else’s property, you are entitled to claim fair compensation from them. Most, but not necessarily all, property owners take out public liability insurance to protect themselves against a claim made against them in the event of an accident and that insurance will cover such a claim. This is known as a public liability claim.
Some types of accidents covered by public liability
- Slips, trips and falls
- School ground accidents
- Unsafe premises, including a property you rent
- Injuries caused by fires
- Electrical shocks
- Dog bites or attack by any other pet
Proof of negligence required
As with all types of personal injury claims, public liability claims cannot be made unless there is proof of negligence, and proof that the negligence caused the injuries. Injuries can be either physical or psychological. The property owner, one or more of their employees or a contractor may be regarded as liable if it can be proven that they were aware that a hazard existed but reasonable steps were not taken to do something about it.
It is never easy proving that negligence has taken place on public or private property. The property owner and their insurance company are often reluctant to admit that they were at fault and may even claim that you were to blame for your own injuries.
In these situations, it is advisable to seek the help of one of our helpful and experienced public liability solicitors at Lennon Mazzeo Lawyers. We provide a free initial consultation and work on a no win no fee basis. If we cannot win your case, then you have nothing to pay.
Don’t delay a claim for too long
We always advise injured accident victims to come and talk about their accident as soon as they can if they think that negligence was involved and someone else was responsible for their injuries. Generally, the sooner a reasonable claim is made, the more likely that sufficient evidence to back it up will be found. If witnesses were around at the time of the accident, their memories will be fresher and their evidence more convincing.
There are also state imposed time limits on public liability claims, which mean that if you delay initiating a claim for too long you may lose your entitlement to claim. In Victoria the time limit is generally 3 years with extra time usually allowed for children to claim.
